Looks like you are in a rush .. You filed your labor in 2007 and expect to get a GC before a guy who is waiting in EB3 from 2002 0r 2003 ?
There is nothing wrong in converting from EB3 to EB2 , if you are qualified . How long you are going to wait in EB3 ?
By the way I m Eb2 2006.

EB2 requires an advanced degree- lets say it takes anadditional 3 years
EB3 can join a job after bachelors and get a PD. 5 years later switch jobs and claim EB2 with teh experience with the old PD
now suddenly the original EB2 filer is behind- his/her years spent getting the advanced degree count for nothing. the PD is 3 years behind the EB3 filer. so the experience suddenly trumps the education because and only because the EB3 filer could file sooner.
the law of the land gives preference to people with advanced degrees.
it allows substitution with experience. so far so good. the problem is the direct PD portability that hands a significant advantage to the EB3 converters ie experience over degree- an unintended consequence of this.

The desperation of your post suggests that you don't need direction, you need therapy. We just need someone to give us some assurance that we will all be fine and live to see the light of the day on Tuesday even if DoS sends out a revised Visa Bulletin. At this time, I too need similar assurance from someone. Can anybody help?

I have interview for AOS employment based on June 20th, 2006. The letter simply says get passport and I94. However i am planning to take all documents with me.
Here are my case details:
- Labor was filed in 2001 Nov in MI
- 140 approved in Oct 2003
- 485 filed in Jan 2004
- changed employer in 2004 Nov on EAD
- RFE for employment letter in Mar 2004
- Case transfered to local office (Newark), May 2005
- 3 EAD renewals, 3 AP renewals
- 25 % more salary than old job. Title in old job was programmer/analyst.
- New job when joined was Systems Analyst.
- For RFE response, supplied a good letter with same job description.
- The current JOb is NJ with a well known insurance company.

Thanks for your reply Eternal_hope! Unfortunately, "Other" is not an option listed. At this stage, I am not really counting on things working out here - have already started making plans to R2I (which is why I am looking to open a IRA account that can be managed online). It's been a long wait and quite frankly, I am tired of living in a constant state of uncertainty, even though I will definitely miss certain aspects of life in USA having been here for almost twelve years now...

I have not done that. I do have EAd and AP so dont know if i will do it. But prior to this when i got promoted earlier i have not applied for an admendment.

I guess if you use EAD and not inform USCIS about the promotion and reply to AC21 RFE (if at it comes asking for employment letter and job duties), you should be fine replying it.
However, if you use H1B, then your AC21 RFE comes and you submit a profile that is different than that of H1B, then USCIS can question that discrepancy.
I am not sure they will do that ... but just a suggestion .. I might be wrong ..

What are the chances of EB3 also getting stuck around Jan 03.
Does any one know reason why so many EB2 were filed before Jan 03. Was there Apr 01 type of deadline??

That is the problem. There is no such thing in the flcdatacenter, but in onet online, there is a

The attorney is not giving out any suggestions on what to do as they already filed, got a high PW and appealed which got denied.

When last time we entered in USA in Feb 2009, We used our H1/H4 visa to enter even if we had our AP in hand. So Her I-94 will show H4 stamping.
Will that make her ineligible for Applying for FAFSA?

What part of "illegal" does Rep. Hostettler not understand? According to Congressional Quarterly, in April 2004, Rep. John
Hostettler (the chairman of the House Immigration Subcommittee) was detained for carrying a loaded firearm inside an airport. He called the incident a "stupid mistake," explaining that he had carried the gun while traveling through his district during a congressional recess and forgot it was in his bag. Hostettler pleaded guilty to carrying a concealed deadly weapon and received a 60-day suspended sentence. Rep. Hostettler's own actions appear to contradict his hardline no-holds-barred enforcement approach towards immigration. Although he excuses his breaking of the law as a mistake, his actions indicate that some laws are OK to break and others are not. Perhaps Rep. Hostettler should reflect on whether undocumented aliens or our nation's broken immigration system is at fault.

There is no other way about it....even if we don't have a vote now, we have a voice...that of a LEGAL immigrant (and a future Citizen!). Each one of you find out where the meeting is going to be, and make a point to attend and atleast ask one question- It has been said that America is a nation of laws and a nation of immigrants- so Congressman, while you're working against ILLEGAL IMMIGRANTS, what are you doing to help LEGAL IMMIGRANTS??? ....... Speaker of House is totally impressed by citizen pressure at a town hall meeting!!
Wait until you see the report below from a Hill staffer of the Speaker's comments in a closed session of congressmen/women.
As I predicted to you in my email Monday morning, the terrible Senate bill has further bogged down this week as U.S. House leaders have become increasingly emboldened by you citizens' phone calls, faxes, office visits and attendance at town hall meetings.
Suddenly this week, Speaker of the House Hastert announced that he wouldn't be immediately appointing House negotiators to hammer out a compromise with Senators in a joint Conference Committee. Rather, he announced a series of public hearings to be held across the country over July and August to get public feedback on the provisions of the Senate bill.
Hahahahaha.
Maybe the 63 hidden provisions in the Senate mystery bill that our Rosemary Jenks uncovered and exposed at the National Press Club (but with very little media interest) will get proper vetting from the American people.
This is such terrible news for the Kennedy/McCain/Bush open-borders folks who had hoped to ram their bill into law without the public truly discovering what was in it.
Even better, Speaker Hastert announced principles that should undergird House action and they were all about enforcement and nothing about increasing legal immigration or guestworkers.
WHAT PERSUADED HASTERT TO DO THIS?
Rep. Hastert (R-IL) has always voted very well but has not been very helpful as a leader. He has been much too eager to please the White House when it asks for favors and to help out the U.S. Chamber of Commerce.
Nonetheless, he has often ended up helping block bad stuff in the House and was a big help in the end in passing the ban on drivers licenses for illegal aliens. But his behavior this week represents a whole new side of Hastert. And it is pretty apparent why he changed.
Check out this email from a Republican staffer to Rosemary describing the closed-door session Hastert had with Republican Members of the House.

You may already have heard this, but it was too good not to pass along. In GOP conference this morning, Hastert started talking about an event he went to with several hundred of his constituents. He went on and on about this was in Illinois, in the heartland of the country, Illinois wasn't a border state -- and every question but one from his constituents was about immigration.

Technically everything that goes on in conference is supposed to stay confidential but my boss was going on about it and how he thought the meeting with his constituents made a huge difference to Hastert.
I thought you'd find it encouraging that all the hard work your minions are doing about bugging the hell out of these guys at public events is working.
You're outgunned, outspent, and outlobbied -- but you're winning. I am now officially cautiously optimistic.

Yes! I have my H1-B Case Filing Receipt Notice with EAC number.
I see the same message (as you posted) when I tried to see the status first time around Mid Nov. I thought it may take few days or a week to appear online (based on the past). But, same message till now!!
Something is not linked right and may be due to some upgrade USCIS were doing in last few months. Not Sure!!!

Another option here -
I was on H1B for about 4 years and after that on L1A via a COS for the last 1 year. (total 5 years). Currently I am on L1A with company A.
If my future employer B files for my H1B I don't have to go thru the cap/quota since I already was on an H1. I assume this is correct.
- So till the time my H1B is approved can I still be with employer A on L1A visa?
- Will moving to H1B with company B be my choice (of when I want to resign from company A and move to B) or will I be forced to join company B as soon as my H1B is approved?
- Parallel to the above company B files my GC.

I have a letter (it's in email format) that shows my lay-off is because of "lack of work". However, this letter is for the time before my GC was approved. I suppose that I need to get a letter from the company dated sometime after my GC approval date in order to present that in the time my citizenship process to justify that the job offer was not speculative; right?
That might also possible to get a letter from the company that shows they are willing to hire me in case there's a new project; thanks for your comment on this.
I think as Attorney Prashanthi mentioned, uscis might consider the current economic situation as well but b/w now and 5 yrs uscis might have updated laws too.

Just resolve their issues so you will see most of them opening new businesses, buy houses - this will trigger high financial activity and will improve the economy automatically. Unemployment will be a thing of the past.
With all due respect, this is a bit of a self-serving exaggeration don't you think? Unemployment will be a thing of the past if they give all of us greencards? I trust many will buy properties and start businesses but enough to fix unemployment entirely??? Trust me I want my GC as badly as the next guy in line. With all due respect, this is a bit of a self-serving exaggeration don't you think? Unemployment will be a thing of the past if they give all of us greencards? I trust many will buy properties and start businesses but enough to fix unemployment entirely??? Trust me I want my GC as badly as the next guy in line.
